CHAPTER 1
FOUNDATIONS AND BASIC COMMITMENTS
SECTION 1.1 – NONDISCRIMINATION
The President and the Congress of the United States and the General Assembly of Virginia have enacted laws and issued directives affirming their intent to protect and grant equal opportunities to employees and students. Also, the federal government and Virginia have enacted and enforced laws regarding the quality of employment and equality of opportunities in education.
A. Employees
The York County School Board shall hire, promote, retain, dismiss and/or transfer employees without regard to race, color, creed, sex, national origin, political affiliation, age, disability or belief, except as permitted by state or federal law.
B. Students
In York County School Division, students will be admitted, retained, dismissed, assigned and/or transferred and be allowed to participate in all programs and activities in the York County School Division without regard to race, color, creed, sex, national origin, political affiliation, age, disability or belief, except as permitted by state or federal law.
C. Implementation
The division superintendent shall take appropriate steps to implement and oversee this policy in accordance with federal and state laws and regulations, including
- designating a Title IX Coordinator and giving notice to parents/guardians, students and employees of his/her identity
- establishing procedures for dealing with complaints and grievances alleging violations of this policy as reported by any employee, student or third party
- training of employees on the policy and complaint/complaint procedures
- Publicizing this policy and the procedures for dealing with reported violations to the general public, to parents and to students and to all employees.

SECTION 1.2 - MISSION STATEMENT
The mission of the York County School Division is to ensure the success of all students through a rigorous and innovative instructional program of public education that expects the highest levels of excellence from staff and students. All students will become lifelong learners prepared to compete in a global economy.

SECTION 1.4 - BELIEF STATEMENT
The School Board of the York County School Division believes that:
- All students can learn.
- Student achievement is the core priority of the school division.
- Technology enhances student learning.
- Instructional programs must be evaluated annually.
- Parental and community involvement are essential.
- Learning occurs best in a safe and caring environment.
- Education is a responsibility shared by students, teachers, parents, administrators, and members of the community.
- High expectations are appropriate for all students.
- Equitable programs, facilities, and educational opportunities promote excellence for all students.
- Exceptional school divisions recruit and retain highly qualified and diverse staff.
- Students must be prepared for career choices.
- Mutual respect is essential in all interactions.
- Division employees must be dedicated to positive learning outcomes for all students.
- Multiple educational programs are essential to meet student needs.

SECTION 1.5 – PARENTAL INVOLVEMENT IN SCHOOL ACTIVITIES
It is the policy of this School Board to facilitate and promote the participation of parents in the education of their children. To this end no procedure or practice in any school shall discourage or hinder the participation of a non-custodial parent in their child’s activities in school, such as lunch breaks, special in-school programs, parent-teacher conferences and meetings, and extracurricular activities on the sole basis of non-custodial status. The School Board recognizes the following exceptions to this policy:
- a custodial parent possesses, and presents to the school principal, a court order that expressly prohibits the non-custodial parent’s contact with a child or children;
- an IEP is formulated with the participation of the custodial parent pursuant to current law, IDEA and state regulations;
- the parent designated by the court as "primary care giver" or "physical custodian" has presented to the school principal written restrictions on the non-custodial parent’s removal of the child from school
